New Driving Laws for 2010- Be Aware!

All drivers of motor vehicles should be aware of the significant changes in Illinois laws regarding cell phone use that have been in effect since January 1, 2010.

It is now illegal to use a cell phone while driving in a school speed zone, or in a highway construction or maintenance speed zone, unless the telephone is used in a voice-activated mode. Exceptions exist for law enforcement, emergency, and construction personnel.

In addition, drivers are now prohibited from using a cell phone or other communication device to compose, send or read electronic or text messages. The law does not apply to a GPS or navigational system or a device that is integrated into the motor vehicle.

Exceptions exist for law enforcement and emergency personnel, drivers using the device in a hands-free or voice-activated mode, commercial drivers using an installed device, or for drivers parked on the shoulder of the road or stopped due to traffic obstructions with the vehicle in park or neutral.

Motorists should be careful about where and when they use cell phones while driving. Police agencies have indicated that despite issues of proof, they will enforce these laws, especially when accidents occur. These violations are considered moving traffic violations with a minimum fine of $75.00. With court costs and attorney's fees the actual cost to the motorist may be much higher.
