Termination of Parental Rights

The termination of parental rights is a court action that severs the rights and privileges between a parent and their child. The interest of a parent in the care, custody and control of his or her child is a fundamental liberty interest that is protected by the United States Constitution but an action to terminate parental rights severs that relationship. No rights to care, upbringing, visitation, or even contact with the child exists.

The State can terminate a person’s parental rights if the local county prosecutor demonstrates by clear and convincing evidence that the parent is an “unfit person” and it is in the best interest of the child to do so. The Juvenile Law attorneys of the Law Offices of Edward P. Graham, Ltd. have the necessary experience to represent your vital interest with respect to Petitions to Terminate Parental Rights.
